1.1 Acceptance of Terms

By accessing or using the D-Trading Post ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you must leave immediately and shall not use any portion of this Platform.

1.2 Eligibility

You must be at least 18 years of age to use this Platform. By using the D-Trading Post, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into binding agreements. We reserve the right to terminate any account found to belong to a minor.

1.3 Permitted Use

You agree to use this Platform only for lawful purposes. You shall not:

• List counterfeit, stolen, or prohibited goods
• Engage in fraudulent bidding or shill bidding
• Harass, threaten, or abuse other users
• Attempt to circumvent platform fees or payment systems
• Use automated bots or scrapers without written permission
• Post a listing for one item and knowingly ship a different item (item substitution fraud)
• Violate any applicable local, state, federal, or international law

1.4 Seller Responsibilities

All sellers are held fully and solely responsible for every item they list and sell on D-Trading Post. By posting a listing, you represent and warrant that:

• Item accuracy: The item listed is exactly what will be shipped. Posting one item and shipping a different item constitutes fraud and will result in immediate, permanent account termination and may be reported to the appropriate law enforcement authorities.
• Shipping included: All listed prices must include shipping. Sellers may not charge buyers additional shipping or handling fees after a sale is completed. The price shown is the price paid — full stop.
• Accurate description: Item condition, photos, and descriptions must truthfully represent the item. Misrepresentation is grounds for account termination.
• Legal ownership: You have full legal right to sell the item. You warrant the item is free of liens, encumbrances, or legal disputes.
• Timely shipment: Sellers must ship within 5 business days of a completed sale unless otherwise disclosed in the listing description.

1.5 Platform Non-Responsibility & No Refund Policy

D-Trading Post and DiMase Inc. are not responsible for any items sold, purchased, shipped, or received through this Platform. We are a marketplace facilitator only. Specifically:

• We are not responsible for items that are not received by the buyer.
• We are not responsible for items damaged in transit, lost by a carrier, or seized by customs.
• We are not responsible for issuing refunds, chargebacks, or replacements for any transaction.
• We do not mediate disputes between buyers and sellers.

Refund Inquiries: If you have not received an item or have a dispute with a seller, it is the buyer's sole responsibility to contact the seller directly using the email address displayed on the seller's profile page. D-Trading Post will not intervene in, mediate, or be held liable for the outcome of any such dispute. All sales are final. Subscription fees are non-refundable once a billing cycle has commenced.

1.6 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials. All activity under your account is your responsibility. Notify us immediately of any unauthorized access at dimaseinc@gmail.com.

1.7 Termination

We reserve the right to suspend or terminate any account at any time, with or without cause, with or without notice. Upon termination, all licenses granted herein immediately cease.

1.8 Modifications

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. Material changes will be announced on the Platform homepage.

2.1 License Grant

Subject to your compliance with these Terms, D-Trading Post grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal or commercial buying and selling activities as permitted by these Terms.

2.2 Intellectual Property

All content, features, and functionality of the D-Trading Post — including but not limited to text, graphics, logos, icons, images, audio clips, code, and software — are the exclusive property of Christopher DiMase / DiMase Inc. and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

2.3 User Content License

By posting listings, images, or other content on the Platform, you grant D-Trading Post a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content for the purposes of operating and improving the Platform.

2.4 Restrictions

You may not: (a) copy, modify, or distribute the Platform's source code; (b) reverse engineer or decompile the Platform; (c) remove any proprietary notices; (d) use the Platform to build a competing service; or (e) resell access to the Platform without written authorization.

2.5 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

2.6 Limitation of Liability

IN NO EVENT SHALL D-TRADING POST OR CHRISTOPHER DIMASE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PAST THREE MONTHS.

2.7 Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law provisions. Disputes shall be resolved in courts located in Allen County, Indiana.

3.1 Commission Structure

Sellers are charged a 15% commission on each completed sale. Commission is automatically deducted from the sale proceeds. The seller receives 85% of the final transaction value. This commission covers payment processing, platform maintenance, and buyer protection services.

3.2 Subscription Billing

Subscriptions are billed monthly on the anniversary of your signup date via PayPal. Subscriptions auto-renew unless cancelled before the next billing date. Cancellation takes effect at the end of the current billing period — access remains until then.

3.3 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.

3.4 Non-Refundable

Subscription fees and commissions are non-refundable as stated in Section 1.4 above. No prorated refunds for mid-cycle cancellations.

4.1 Data We Collect

We collect the following information when you use the Platform:

• Account data: username, email address, hashed password
• Transaction data: bids placed, purchases made, listings created, sale amounts
• Technical data: IP address at registration and login, browser user agent, access timestamps
• Payment data: PayPal subscription ID, payment status (we do not store full card numbers)

4.2 How We Use Your Data

We use collected data to: operate the Platform, process transactions, detect fraud, enforce these Terms, communicate important notices, and improve our services.

4.3 Data Sharing

We do not sell your personal data. We may share data with: payment processors (PayPal) as necessary to process transactions; law enforcement if legally required; and service providers who help us operate the Platform under confidentiality agreements.

4.4 Data Retention

Account data is retained for as long as your account is active plus 2 years after deletion, as required for financial recordkeeping. Transaction logs are retained for 7 years per financial regulations.

4.5 Your Rights

You may request a copy of your personal data, correction of inaccurate data, or deletion of your account by contacting us at dimaseinc@gmail.com. Note that some data may be retained as required by law even after deletion.

4.6 Security

We use industry-standard encryption and security practices. However, no system is 100% secure. You use the Platform at your own risk. We are not liable for unauthorized access to your data resulting from your own actions.

4.7 Cookies & Sessions

We use session cookies solely to maintain your login state. We do not use tracking cookies, advertising cookies, or third-party analytics cookies.
